Against Accused Kazaa User Tenenbaum
On July 31, the judge presiding over a trial in which
a Boston University doctoral student faced liability for online
infringement of musical works granted copyright owners' motion for a
directed verdict of infringement. Considering testimony by the
defendant, Joel Tenenbaum, who took the stand on July 30, the court
concluded that there was no issue for the jury on the question of

INTERNET COMMERCE Microsoft-Yahoo Advertising Deal
Expected to Face Government Scrutiny
Microsoft
Corp. and Yahoo, Inc. July 29 announced a 10-year agreement allowing the
companies to combine their strengths in the area of online search
advertising, immediately raising competition and privacy concerns.
Under the plan, which is expected to face government scrutiny, Yahoo has
agreed to make Microsoft's "Bing" search engine the exclusive paid search
platform on its websites, while Microsoft has promised to pay Yahoo 88
percent of revenue generated from Yahoo sites during the first five years

Argentine Judge Holds Google, Yahoo!
Liable for Posting of Third Party Content
An Argentine civil court July 29 held
Google and Yahoo! liable for content posted by third parties, rejecting
the search engines' contention that they were mere intermediaries and
therefore not responsible for the actions of pornographic and
female-escort websites that posted pictures of a model and actress without
her consent. The National Civil Court No. 75 in Buenos Aires ordered
Google and Yahoo! to pay a total ARS100,000 ($26,248) in damages—ARS50,000

National Broadband Plan
Federal Communications Commission Chairman Julius Genachowski Aug.
4 announced a team made up of private sector workers and senior agency
staff who will be assisting Blair Levin in developing a congressionally

Need for Privacy Legislation, Boucher Says
Rep. Rick Boucher (D-Va.) said July 30
that recent steps by the online advertising industry have not changed his
mind about the need for Congress to enact comprehensive privacy
legislation. Boucher, a key member of the House Energy and Commerce
Committee, commended industry groups for unveiling new privacy principles

TAXATION Federal Legislation's Prospects Up in
Air, SSUTA President Says
The president of the Streamlined Sales Tax Governing Board, Inc.
July 29 offered a personal opinion that the prospect for passage of
federal streamlined sales tax legislation in Congress by the spring of
2010 appears "no greater than 50-50." When asked in a follow-up call
to elaborate, President John Doyle of West Virginia characterized his
observation as "an off-the-cuff remark." The comment by Doyle came
during the streamlined sales tax group's executive committee
