Court Denies Summary Judgment on Issue of YouTube's Right, Ability to Control Content 
 
The extent to which YouTube has the right and ability to control allegedly infringing content posted on its video-sharing web site is a question of fact that cannot be disposed of at the summary judgment stage, the U.S. District Court for the Central District of California ruled June 20.  Denying YouTube's motion for summary judgment on the question of whether it is eligible for a safe harbor under the Digital Millennium Copyright Act, the court noted that YouTube did engage in a "significant" level of "maintenance and management" regarding the content posted on its web site.  Tur v. DOJ Reaches Accord with Microsoft Over Google's Complaint About Vista 
 
Microsoft Corp. has agreed to make changes in the search function in the Windows Vista software to settle allegations by Google that Microsoft was in violation of a 2001 antitrust settlement.  The Justice Department June 19 advised the U.S. District Court for the District of Columbia that the federal government, 17 state attorneys general, and the District of Columbia have reached an agreement.  Google raised the issue relating to the desktop search capabilities in Windows Vista, reported in the Joint Status Report on Microsoft's Compliance with the Final Judgments which was filed on June 19.  Read more ...

Local Officials Ask Court to Stay FCC's New Video Franchise Rules 
 
Local government organizations June 20 asked a federal appeals court to stay the implementation of the video franchising order adopted last year by the Federal Communications Commission that could go into effect soon.  State and local government organizations objected to the rules when they were adopted on a 3-2 party line vote in December 2006.  The order [FCC 06-180] establishes a 90-day time frame for local franchise authorities to approve video franchise applications by providers with existing access to rights of way, and a six-month time frame for new entrants.  Alliance for Community Media v. Under Decree, Online Marketers to Pay Refunds, Fines in Privacy Promise Case 
 
Eight online marketers who promised to protect the privacy of consumers' personal information but were accused of selling the data instead agreed to pay civil damages to end a state Consumer Protection Act enforcement action, under a consent decree approved June 21 by a Washington state court.  The marketers obtained the consumer information by offering "free" product rewards over the Internet to those who submitted their personal data.  State of Washington v. N.Y. Tax Department Guidance Memo Clarifies Taxation of VoIP Services 
 
Telecommunications services provided through Voice over Internet Protocol (VoIP) are subject to the same state sales taxes and telecommunications excise taxes as services provided over conventional phone lines, the state Department of Taxation said in a June 20 guidance memo.  The department, citing language in the state Tax Law, said VoIP services constitute "telephony and telegraphy and telephone and telegraph" services for purposes of the sales tax and excise tax.  "The use of the Internet or Internet routing protocols for transmission of all or part of the call does not change this result," the memo said.  New York Office of Tax Policy Analysis Technical Services Memorandum NYT-G-07(3)S, 2007 ILRWeb (P&F) 2049.  Read more ...

Seller's Single eBay Sale Into Buyer's Forum Not 'Transacting Business' There 
 
A single eBay sale to a Massachusetts buyer does not constitute "transacting business" in the state for purposes of Massachusetts's long arm statute, the U.S. District Court for the District of Massachusetts held June 7.  The court, relying on an extensive collection of analogous cases, said that an isolated sale through the eBay Internet auction site will not support jurisdiction over an out-of-state seller. The court also concluded that the sale did not satisfy jurisdictional requirements under the civil Racketeer Influenced and Corrupt Organizations Act, which the court read to require an intentional connection with the forum.  Ginsburg v. Full Ninth Circuit Won't Review Panel Ruling That Company Consented to FBI Porn Search 
 
The U.S. Court of Appeals for the Ninth Circuit June 21 refused to conduct an en banc review of the conviction of a Montana executive who had child pornography on his office computer, but 11 judges dissented, stating that a three-judge panel of the court mistakenly concluded that Frontline Processing consented to an FBI search of the operations director's computer hard drive.  En banc review of the conviction of Jeffrey Ziegler was denied because it was not supported by a majority of the active judges on the court.  But Judge William A. Fletcher said that the court should have granted review in order to correct the panel's "erroneous view of the protection provided by the Fourth Amendment."  United States v.
